Opća uredba o zaštiti osobnih podataka GDPR - krediti građanima mogli bi se usporeno odobravati mjesecima

Zbog Opće uredbe o zaštiti osobnih podataka GDPR (General Data Protection Regulation), krediti građanima mogli bi se usporeno odobravati mjesecima i to zato što banke u predstojećem razdoblju neće raspolagati informacijama iz Hrvatskog registra obveznika kredita koji je odlučio privremeno obustaviti isporuku kreditnih izvještaja o građanima. S obzirom na to da su banke vlasnice HROK-a, situacija djeluje malo apsurdno, no činjenica je da financijske institucije strahuju od ciljanih tužbi pojedinaca za neovlašteno korištenje osobnih podataka. A na meti su – financijski potkoženi igrači.
 
Izvan funkcije i 'crna lista' Ta je bojazan upakirana u apstrahiranu izjavu u jučerašnjem zajedničkom priopćenju Hrvatske udruge banaka i kreditnog registra kako će od 25. svibnja privremeno zaustaviti isporuku izvještaja zbog tehničke i regulatorne prilagodbe poslovanja, kojom žele otkloniti svaku potencijalnu nejasnoću u budućoj primjeni GDPR-a te će nastaviti s poslovanjem u punom opsegu registrirane djelatnosti odmah nakon zadovoljavajuće prilagodbe novom propisu. Dok se ne donesu precizniji propisi u nacionalnom zakonodavstvu, što može potrajati mjesecima, HROK ne kani davati podatke o građanima, pa ni o obrtima, OPG-ovima, slobodnim zanimanjima. No, i dalje će isporučivati kreditna izvješća o pravnim osobama. Izvan funkcije je i omražena 'crna lista' – sustav razmjene informacija o klijentima koji nisu ispunili svoju dospjelu obvezu u roku, koji je organiziran pri Hrvatskoj udruzi banaka. Banke se, znači, u svojim kreditnim politikama vraćaju na razdoblje prije 2007. kad je utemeljen HROK. Jasno, krediti su se i tada odobravali, no u međuvremenu je regulativa postala značajno stroža i kompliciranija pa je iluzorno očekivati da će se proces odobravanja kredita građanima nastaviti glatko. Jer bankarima sad nedostaje temeljni alat procjene. Teško je i zamisliti koliki bi tek bio udio loših kredita u krizi da tad već nije bio u primjeni HROK. I dok u HUB-u priznaju da bi proces odobravanja kredita mogao trajati dulje, jer će sve dok HROK ne nastavi s radom biti složenije pribaviti potrebne dokumente za obradu kreditnih zahtjeva, tri banke koje su nam odgovorile na upit na tu temu tvrde suprotno: iz Splitske poručuju da kod njih u tom prijelaznom razdoblju zastoja neće biti, a u Addiku da su kreditno poslovanje već uskladili s promjenama. dok su u Erste banci precizirali da će im klijenti davati izjavu o svojim dugovanjima, a klijenti drugih banaka prilagati izvješća o prometu po računima u svojim matičnim bankama. Kreditni registar ne ometa zaštitu podataka Iz HNB-a poručuju da primjena GDPR-a od kreditnih institucija i kreditnih registara nije u njihovoj nadležnosti. -HNB je putem kontakata s HUB-om te kreditnim institucijama upoznat s otvorenim pitanjima i mogućim rizicima vezanim uz primjenu GDPR-a u dijelu koji se odnosi na kreditne registre, tj. na HROK. Opća uredba o zaštiti osobnih podataka ne sadrži odredbe koje priječe funkcioniranje registara obveza po kreditima. Takvi registri postoje u većini zemalja članica EU te ne postoje naznake da bi stupanjem na snagu Opće uredbe u nekoj od zemalja oni mogli prestali funkcionirati. Svakako, registri moraju svoj rad uskladiti s Uredbom; tumačenje primjene Uredbe je u nadležnosti Agencije za zaštitu osobnih podataka (AZOP), a rješavat će se sigurno i u dijalogu svih uključenih institucija', tvrde u HNB-u. Potraje li – mogu rasti kamate U HUB-u takvo stanje smatraju privremenim i kažu da bi u suprotnom moglo doći do usporavanja kreditiranja, smanjenja intenziteta tržišne utakmice pa i porasta kamatnih stopa. Zato računaju da će što prije u suradnji s regulatorom osigurati nastavak rada HROK-a. U bankarskim krugovima HNB-u zamjeraju da se prema GDPR-u ponašao lakonski, no prema njihovim informacijama sad je i supervizor intenzivirao aktivnosti na tu temu.

Nove izmjene Ovršnog zakona na snazi od 01.01.2018.godine

Da su prošle godine vrijedila ovogodišnja pravila, banke tvrde da gotovo svaki treći klijent koji je zatražio stambeni kredit ne bi mogao zadovoljiti kriterije. Iz toga proizlazi da bi izmjena Ovršnog zakona, kojom se umjesto dvije trećine od ovrhe moraju zaštititi tri četvrtine plaće, mogla znatno utjecati na ovogodišnje odobravanje stambenih kredita.
